Terms and Conditions for Windham Tech

By accessing our website, purchasing our retail products, or utilizing our repair and design services, you agree to the following terms:

1. Repair Services & Liability

  • Data Responsibility: Customers are responsible for backing up all data prior to repair. Windham Tech is not responsible for data loss, hardware failure, or software corruption during the diagnostic or repair process.

  • Pre-existing Conditions: Windham Tech is not liable for pre-existing damage, such as liquid damage or board-level micro-fractures, that may worsen during a standard repair attempt (e.g., screen removal).

  • Abandoned Property: Any device left at Windham Tech for more than 60 days after notification of completion will be considered abandoned and may be sold or recycled to recover service costs.

2. Retail Sales & Inventory

  • Returns: Unopened retail items (e.g., PC components, peripherals) may be returned within 14 days with a original receipt. Opened items are subject to a 15% restocking fee.

  • Defective Goods: Defective hardware is subject to the manufacturer’s warranty. Windham Tech will assist with the RMA process where possible but is not the warrantor of third-party goods.

3. Web Design & Professional Services

  • Project Scope: Services are limited to the items listed in the signed Project Proposal. Additions outside the agreed scope will be billed at our standard hourly rate or under a separate agreement.

  • Maintenance Plans: Monthly maintenance plans cover security and updates. They do not include major structural redesigns unless explicitly stated in the service agreement.

  • Ownership: Upon final payment, clients own the design and content of their site. Windham Tech retains the right to display the project in our professional portfolio.

4. Payments & Refunds

  • Deposits: A non-refundable deposit of 50% is required for all custom hardware builds and web design projects.

  • Service Fees: Diagnostic fees are non-refundable but may be applied toward the final cost of a successful repair.

  • Late Payments: Payments overdue by 30 days are subject to a 1.5% monthly late fee.

5. Governing Law

These terms are governed by the laws of the State of New York. Any disputes shall be resolved in the courts of Greene County, NY.
